Constructive Dismissal – Grievance Procedure is key!

Where an employee resigns and claims constructive dismissal under the Unfair Dismissal Act 1977 (as amended), the employee must exhaust all internal procedures before resigning. This includes the grievance procedure. It is only in exceptional circumstances that an employee does not need to do this. In this case, the employee resigned from his employment but lost the case due to not using the company grievance procedure to deal with his concerns first.
