Dismissal for Taking Paternity Leave

In this case, the employee alleged he has been dismissed for a number of reasons, one of which was due to seeking paternity leave under the Paternity Leave and Benefits Act 2016 (as amended).

The employee had less than one year’s service and was therefore only eligible to have his claim for dismissal due to paternity leave considered as this does not require 12 months service.

The employee outlined losses of approximately €10,000 however it was found that as dismissal for seeking paternity leave was one of three grounds given, that the award would be reduced proportionally in this regard.
