In this case the claimant alleged he was discriminated against by Westwood Fitness Club by being refused access to a “female only” section of the gym.
The gym’s position was that the claimant was refused because some female gym members were of muslim faith and their religion prohibited them from attending a gym with other male members present. The gym fet that this was jusifification for refusing the claimant entrance.
The Workplace Relations Commission held that it was discrimination on the grounds of gender to refuse the claimant access to the “female only” areas however they were justified in doing so “based on the very specific needs of a category of persons who would not otherwise be able to participate”.
