A civil claim for wrongful dismissal before the civil courts is different from a claim for unfair dismissal pursuant to the Unfair Dismissal Acts 1977 (as amended) which is before the Workplace Relations Commission. This case highlights the difference.
It was ultimately held that an employee who was dismissed on the basis of a “no fault dismissal” was still entitled to protections of natural justice and fair procedure in accordance with the Unfair Dismissal Acts 1977 (as amended)
