Health and Safety – €1 million fine imposed on Company by Wexford Circuit Court

It was reported earlier this week that Nolan Transport had been fined €1 million by the Circuit Court in Wexford in respect of an accident in July 2007 which resulted in the death of two people and several others injured.It was reported by the Health and Safety Law Review that the Company pleaded guilty to failing to manage and conduct its affairs, in such a way as to ensure, so far as is reasonably practicable, that in the course of its work people not in its employment were not exposed to risks to their safety, contrary to Section 12 of the Safety Health and Welfare at Work Act 2005 (as amended). It was also reported that the court ordered that the fine be paid in three instalments and also ordered the company to pay costs of €70,000.We will be reporting on this case in further detail next week.
